Sex bloggers, Alvin Tan and Vivian Lee, who are currently being charged at the Sessions Court in Jalan Duta, have pleaded not guilty to three charges.

The pair were charged under the Penal Code, Film Censorship Act 2002, and the Sedition Act 1948.

The deputy public prosecutors, Noorin Badaruddin and Ishak Md Yusoff, have asked the judge for all three charges to be tried simultaneously.

However, the defence argued that the the Film Censorship charge was different as it involved pornography and was commited on different dates.

The judge contemplated both arguments and has decided that all three charges will be heard simultaneously.
In the first charge, they were jointly accused of making a seditious posting on "Alvin and Vivian - Alvivi" Facebook for posting up a controversial “Selamat Berbuka Puasa” greeting on their joint Facebook account where the couple is clearly eating bak kut the, a traditional pork dish.

They were charged under subsection 4 (1) (c) of the Sedition Act 1948 which is punishable under subsection 4 (1) of the same Act and read together with Section 34 of the Code Penal.

They face a fine up to RM5,000, imprisonment up to three years or both, and imprisonment up to five years for subsequent offence.
In the second charge, Tan and Lee were accused of displaying pornographic pictures ON THEIR Tumblr account.

They were charged under subsection 5 (1) of the Film Censorship Act 2002 which is punishable under subsection 5 (2) of the same Act which carries a fine of between RM10,000 and RM50,000 or imprisonment of up to five years or both, if convicted.


The judge have also denied bail to both of the accused. They will be sent to jail where Alvin will be sent to the Sungai Buloh prison while Vivian will be sent to the Kajang prison.

Earlier, Deputy Public Prosecutor Noorin Badaruddin asked the court not to grant bail to the accused as the charges under Section 298A (1) (a) of the Penal Code and the Film Censorship Act were non-bailable offences.

"Of course, we accept the court discretion to allow bail on the two charges, but the prosecution objected to any bail granted until the trial is over," he said.

Noorin said secondly, both accused had a tendency to upload pictures that could arouse public outrage.

No strangers to the limelight, the couple known as Alvivi, is famous for their sexcapades video blog that went viral last October.
