Kuala Lumpur High Court today fixed Nov 29 for the hearing of Bersih Election Coalition chairperson and Adil (Bersih 2.0), Maria Chin’s habeas corpus application to challenge her detention under the Security Offences (Special Measures) Act 2012 (SOSMA).

The date was fixed by Judicial Commissioner of the High Court Kuala Lumpur, Datuk Nordin Hassan after a hearing here today.

Maria, who was represented by counsels, Gurdial Singh Nijar, Ambiga and Paulsen filed a habeas corpus application to seek her immediate release, and not to be detained or arrested after that.

In her notice of motion, Maria, 60 has named Supt Tham Lai Kuan of the Bukit Aman Criminal Investigation Department, Inspector-General of Police, Home Minister and the Government as the respondents.

The respondents had requested for seven days to file an affidavit to reply to her application.

Guardial, however said the judge has denied the request ,as the respondent has made statement on her arrest and there was no provision for the stipulated seven-day period.

Therefore, the Commissioner of Justice has fixed Nov 28 for the respondents' reply and Nov 29 for the hearing.

He also said that to date, it has yet to be determined if Maria would be present during the hearing of the application.

Maria was detained on the eve of the Bersih 5 rally after police raided Bersih headquarters in Petaling Jaya, Selangor. Also arrested was Bersih 2.0 secretariat manager, Mandeep Singh.

Maria was among 15 individuals who were detained in connection with the an illegal rally here on Saturday.

Last Sunday, Maria's family reported that police had allegedly treated Maria badly in the lock-up since she was detained on Nov 18.

The rally, held last Saturday attracted an approximate 15,500 yellow shirts supporters.
